tire rub against inside bolt -- need advice

Hey guys & gals--

I had a great commute to work today. It was a bit windy, but other than that it was a great day to ride.

I got bummed out and concerned when I got home though...

For those of you following my "rear chop job", you may be aware that I was planning on using bungee nuts and bolts through my extra holes in the rear fender where the fender strut used to bolt to.

I did it. I secured the bungee nuts. I installed 4, 2 on each side. The right side inside bolt heads clear the tire no problem. It's one of the left ones that gave me trouble.

I inspected the tire after work to see that one of the bolt heads made apparently regular contact with the tire. The bolt head was covered in black and the tire "meaty tread" has scratches and small chunks out of it.

The tires are brand new! Do you see this as a safety hazard? I've seen monster truck tire tread cut out with razors for better traction. The side walls were *not* affected at all, just the wearable tread area.
